These Terms and Conditions ("Terms") govern your access to and use of the website ammaterre.com, as well as the purchase of our products and services (collectively, the "Services"), operated by SFK Beauty Products LLC, a limited liability company organized under the laws of the State of Florida, United States ("Ammaterre", "we", "us", "our").

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to these Terms in their entirety. If you do not agree with any provision, please do not use our Services.

1. ELIGIBILITY AND USE OF THE SITE

By using our Services, you represent and warrant that:

- You are at least eighteen (18) years of age, or have the express consent of a legal guardian.
- The information you provide is truthful, accurate, and kept up to date.
- You will not use the site for unlawful, fraudulent activities, or activities that infringe upon the rights of third parties.

Images are for reference. Slight variations in color, texture, or aroma may occur due to the artisanal nature of our formulations and the use of botanical ingredients.

3. PRICES, TAXES, AND PAYMENT METHODS

All prices are listed in United States dollars (USD), unless otherwise indicated. Prices do not include taxes or shipping charges, which are calculated at checkout.

We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the chosen method.

We reserve the right to cancel orders for:

- Suspected fraud or unusual activity.
- Manifest pricing or descriptive errors.
- Verified lack of actual stock following purchase.
- Breach of these Terms.

In the event of cancellation, the full amount charged will be refunded to the original payment method within the timeframes established by the payment processor.

4. SHIPPING AND DELIVERY

Shipping conditions are governed by our Shipping Policy, available on the website. Delivery times are estimates and may vary based on the carrier, customs, and destination.

Ammaterre is not responsible for delays caused by courier services, customs holds, or events of force majeure. Risk of loss transfers to the customer when the order is delivered to the carrier.

5. RETURNS AND REFUNDS

Requests for returns, exchanges, or refunds are governed by our Returns Policy, available on the website, which is incorporated by reference into these Terms.

6. PRODUCT USE AND MEDICAL DISCLAIMER

Our products are cosmetics for external use only. They are not intended to diagnose, treat, cure, or prevent any disease and have not been evaluated by the United States Food and Drug Administration (FDA) for such purposes.

Before first use, we recommend performing a patch test on a small area of skin. Discontinue use if any adverse reaction occurs and consult a healthcare professional.

Information published on the site, blog, or social media is provided for educational and informational purposes only, and does not substitute medical, dermatological, or professional advice. Results may vary between individuals based on skin type, habits, and consistency of use.

7. CUSTOMER TESTIMONIALS AND REVIEWS

The site may display customer reviews, photographs, and testimonials (collected through platforms such as Judge.me) reflecting genuine individual experiences. These testimonials are authentic but do not represent guaranteed results, in accordance with the United States Federal Trade Commission (FTC) guidelines.

By posting a review, photograph, or comment on any Ammaterre channel, you grant SFK Beauty Products LLC a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, adapt, and display such content for marketing purposes, without obligation of further compensation. You represent that you own the content posted and have obtained any necessary consents.

We reserve the right to moderate, edit, or remove reviews that contain offensive language, false information, or that infringe upon third-party rights.

8. INTELLECTUAL PROPERTY

All content on the website —including text, photographs, illustrations, logos, designs, trademarks, formulations, packaging, videos, and overall visual layout— is the exclusive property of SFK Beauty Products LLC or used under license, and is protected by United States intellectual property laws and international treaties.

The following are prohibited:

- Reproducing, distributing, modifying, or creating derivative works without written authorization.
- Using our trademarks or logos on other sites, products, or marketing materials.
- Capturing site content for commercial purposes.

9. NAME, IMAGE, AND LIKENESS OF STEFANIA FERNANDEZ

The name "Stefania Fernandez", her image, voice, signature, photographs, and references to her public career (including her title of Miss Universe 2009) are used under exclusive license by SFK Beauty Products LLC and are protected by rights of personality and publicity recognized under the laws of the State of Florida and the United States.

The following are strictly prohibited:

- Using the name, image, voice, or likeness of Stefania Fernandez to promote products, services, or causes without prior written authorization.
- Suggesting unauthorized association, sponsorship, or endorsement.
- Publishing content that falsely suggests a third party represents Stefania Fernandez or Ammaterre.

Violations will be prosecuted to the full extent of the law, including actions for damages, injunctive relief, and attorneys' fees.

10. USER-GENERATED CONTENT AND SOCIAL MEDIA

By tagging Ammaterre (@ammaterre) on social media with the official brand hashtag, or by sending us content via direct message, email, or any other means, you grant SFK Beauty Products LLC permission to reproduce and publish such content on our channels (website, social media, emails, advertising), with credit to the original author when possible.

This license is non-exclusive, worldwide, royalty-free, and indefinite, except upon explicit request from the author to remove the content.

11. ACCOUNT TERMINATION

You may request the deletion of your account and unsubscribe from communications at any time by writing to hello@ammaterre.com. We will retain the minimum records required by tax and commercial law.

Ammaterre may suspend or terminate accounts that breach these Terms, make fraudulent purchases, abuse customer service, or post offensive content on our channels.

12. PRIVACY AND COOKIES

The processing of your personal data is governed by our Privacy Policy, available on the website. Use of the site involves the use of cookies and similar technologies to enhance your experience, as detailed in the same policy.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by the laws of the State of Florida and applicable federal law, SFK Beauty Products LLC, its officers, employees, affiliates, and suppliers shall not be liable for:

- Indirect, incidental, special, punitive, or consequential damages.
- Lost profits, loss of data, or loss of business opportunity.
- Skin or allergic reactions arising from product use without having performed a patch test.
- Interruptions, errors, or technical failures of the site.
- Damages caused by third parties, including carriers, payment platforms, or social media networks.

Ammaterre's total aggregate liability for any claim shall not exceed the amount actually paid by the customer in the six (6) months preceding the event giving rise to the claim.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SFK Beauty Products LLC, its officers, employees, and affiliates from any claim, demand, damage, cost, or expense (including reasonable attorneys' fees) arising from:

- Your breach of these Terms.
- Your improper use of the site or products.
- Violation of third-party rights.
- Content posted by you on our channels.

15. MANDATORY ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any controversy, claim, or dispute arising in connection with these Terms, the Services, or Ammaterre products shall be resolved through binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Broward County, Florida, in the English language.

The parties expressly waive their right to:

- Resolve disputes in traditional courts (except small-claims matters in small-claims courts).
- Participate in class actions, representative actions, or consolidated arbitrations.
- Trial by jury.

The arbitration award shall be final and enforceable. Each party shall bear its own fees unless the arbitrator orders otherwise.

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. For matters not subject to arbitration, the parties submit to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

17. FORCE MAJEURE

Ammaterre shall not be liable for breaches resulting from causes beyond its reasonable control, including natural disasters, pandemics, acts of government, armed conflicts, infrastructure failures, cyberattacks, strikes, or supplier disruptions.

18. MODIFICATIONS TO THE TERMS

We may update these Terms at any time. The current version will be posted on the site with the updated date. Continued use of the Services constitutes acceptance of the modified Terms. We recommend reviewing this page periodically.

19. GENERAL PROVISIONS

- If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force.
- Failure on our part to enforce any right does not constitute a waiver.
- These Terms, together with the Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and Ammaterre.
- In the event of any discrepancy between the Spanish and English versions of these Terms, the English version shall prevail for legal purposes.
